On Friday the August 20th 2021, it came – more than 7 years after the protests against the WKR Ball 2014 – still a guilty verdict against an anti-fascist demonstrator.

In 2014, thousands of people demonstrated against the ball, which is an important networking event for the European far-right. This resulted in increased damage to property in the city center and the police lost control of the situation.

The case of Josef became particularly well-known, who was arrested and remanded in custody in the course of the demonstration and sentenced to twelve months imprisonment, eight months of which were conditional, for breach of the peace, damage to property and bodily harm. In total, Josef served almost 6 months in custody and was released after the trial. Already at that time there was much criticism of the verdict, it seemed to be less about evidence than about being able to present a harsh sentence to the media.

As with Josef, the now convicted man was brutally arrested directly that evening. However, he was injured so badly that he was not taken to the police station, but was hospitalized. Now the demonstrator was sentenced to seven months of conditional imprisonment for attempted resistance to state authority and attempted grievous bodily harm. He was acquitted of the charge of collective use of force (in 2014 the paragraph was still called breach of the peace) and further charges of grievous bodily harm. The only evidence was the contradictory statements of the two arresting police officers. Why the proceedings were left until 2021 is not entirely clear. The police investigation had already been completed since the end of April 2014, but the proceedings were still delayed until now – deliveries were screwed up and there were several changes of judge.
